Terms of Service – SHOMA AI Health API

1. Acceptance of Terms

By accessing or using the SHOMA AI Health API ("Service"), the hospital, clinic or authorised entity ("Customer") agrees to these Terms. If you are entering into these terms on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Intended Purpose and Professional Use Only

The Service is provided solely as an administrative tool to help authorised healthcare professionals reduce documentation and administrative workload. • The Service is intended exclusively for use by qualified staff of hospitals and clinics. • Patients have no access to the Service. • The Service does not provide medical advice, diagnoses, treatment recommendations or clinical decision support. • All final clinical decisions remain the sole responsibility of the licensed doctor or qualified healthcare professional.

3. Zero Data Retention

Customer acknowledges and agrees that: • All uploaded documents and generated reports are temporary. • Data is cancelled and permanently deleted immediately after the report is delivered. • We do not store, retain or use any patient data for any purpose after processing.

4. Customer Responsibilities

Customer is solely responsible for: • Ensuring only authorised professional users access the Service. • Reviewing every AI-generated report before any clinical use. • Complying with all applicable medical, data-protection and professional regulations. • Not relying on the Service as a substitute for professional medical judgement. • Keeping account credentials and API keys secure, and for all activity under the account.

5. No Medical Device Claims

The Service is not a medical device under the EU Medical Devices Regulation (MDR) and is not intended for any medical purpose listed in Article 2 MDR. It is provided strictly as an administrative support tool.

6. Limitation of Liability

The Service is provided "as is" to the maximum extent permitted by law. To the maximum extent permitted by law, we accept no liability for any clinical decisions, diagnoses, treatments or patient outcomes that result from the use (or non-use) of the Service. The Customer and the treating healthcare professional remain fully responsible. Nothing in these terms limits liability that cannot be limited under applicable law.

7. Intellectual Property

All rights in the Service remain with us. Customer receives only a limited, non-exclusive right to use the Service in accordance with these Terms.

8. Fees and Billing

Paid plans are billed as described at checkout. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.

9. Termination

We may suspend or terminate access if these Terms are breached. Upon termination, any remaining temporary data is deleted in accordance with our zero-retention policy. You may stop using the Service and delete your account at any time.

10. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles.
